INTRODUCTION

 

• Welcome to The Wonder Vet, a pet clinic with highly qualified veterinarians, located within South Kolata, West Bengal. The Wonder Vet operates a website https://wondervet.in/ which allows its users to avail of services including, but not limited to, leading medical imaging services and consultations for small animal(s) & domestic birds. These Terms and Conditions (“Terms”) are intended to make you aware of your legal rights and responsibilities with respect to your access to, and use of, the website and/or the services provided by The Wonder Vet. In these Terms, “we”, “us”, “our”, or “The Wonder Vet” refers to The Wonder Vet, a sole praetorship registered with the Rajpur Sonarpur Municipal Corporation, S-24 Parganas, Govt of West Bengal and “you”, “your”, “User(s)” or “Owner(s)” shall refer to you as the website user and/or an owner availing of services from The Wonder Vet. Please read these Terms carefully. By using our website and/or services, you confirm that you accept these Terms of use and that you agree to comply with them. If you do not agree to these Terms, you must not use our website and/or services. Upon availing of our services and accessing the website, including any version of this website that has been amended to geographically suit its users, you will be asked to consent to being bound by these Terms as well as our website privacy policy (“Privacy Policy”). Users are hence advised to review these Terms and our Privacy Policy prior to the use of our website and/or services. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us in relation to your use of the website and our services.

 

 

DEFINITIONS

 

• When used in this Agreement, the following definitions and rules of interpretation shall have the respective meanings indicated, such meanings to be applicable to both the singular and plural forms of the terms defined:
• “Applicable Law(s)” means the relevant commercial and/or digital laws of the Govt. of WB and any country or region from where you are accessing the website;
• “Content” means any information, text, links, graphics, photos, audio, videos, data, code, or other materials or arrangements of materials that you can view on, access, or otherwise interact with through the website and/or has been provided to The Wonder Vet. The Content that you contribute, submit, transmit, and/or post to, or through the website, shall be referred to variously as “Your Content”, “Content of yours”, and/or “Content you submit.”;
• “External Sites” has its meaning given to it under Clause I 1.6 below;
• “Intellectual Property” means all (i) patents, improvements thereof, patent applications and registrations, inventions (whether patentable or not) (ii) trademarks, trade names, trade-mark applications and registrations service marks, domain logos and designs; (iii) copyrights, copyright applications and registrations; (iv) trade secrets, know-how, and other intellectual property; and (v) computer systems and applications software, including all documentation and modifications thereof;
• “Minor” has its meaning that holds of age groups 6-17yrs.
• “Owner(s)” means Owners, representatives of the Owners and/or companies owning the animal(s) and availing of the services from The Wonder Vet;
• “Policies” means any terms, conditions, and policies (separate from these Terms), made available on the website or in-person at The Wonder Vet
• “Service(s)” means the services provided by The Wonder Vet including, but not limited to, medical imaging (magnetic resonance image (MRI) and a computed tomography (CT)), medical laboratory, orthopaedic surgery, grooming, and/or consultations;
• “Terms” means the Clauses of these Terms and Conditions;
• “Use” has its meaning given to it under Clause II 3.3 (ii) below;
• “User” means the User of the website who is either viewing and/or booking Service(s) from The Wonder Vet;
• “Website” means the website https://wondervet.in/ owned by The Wonder Vet to provide and facilitate e-commerce services such as the viewing and booking of Service(s) to the User;
• “The Wonder Vet” means The Wonder Vet, a pet clinic holding trade license number 0917P743222274287/ Existing Reg No 20034123094. (Rajpur Sonarpur Municipality, Baruipur, South 24 Parganas)

 

 

1. USE OF THE WEBSITE

 

·     1.1 Owner(s) shall be required to create an account in order to use and access the Website. Whilst using the Website, the User must provide complete and accurate information, and warrant to update such information as and when required. This would be in cases where the Owner wishes to send an inquiry through our ‘Contact Us’ section.

·     1.2. Whilst using the Website, you represent and warrant that all information provided to us in such process is true, accurate, and correct, and that you will update your information as and when necessary, in order to keep it recent. You may not impersonate any person or entity, provide an e-mail address other than your own, provide or use false information to obtain access to the Website that you are not legally entitled to claim, or otherwise mislead as to the origin of a card or other content. You acknowledge that any access to The Wonder Vet using falsely claimed information may cause us, or third parties, to incur substantial economic damages and losses for which you may be held liable and accountable.

·     1.3 The Website shall contain a careers section as well, through which User(s) may submit their resume, required documents and/or any other additional documents they may wish to submit. The information provided shall be stored by The Wonder Vet, who at their sole discretion, may decide whether they want to consider the application further and respond to the User.

·     1.4 We reserve the right to amend these Terms at any time without prior notice, and the Users’ continued use of the Website, following the amendments represents their agreement to be bound by the Terms as amended. It is hence the responsibility of each User to review these Terms regularly while using the Website.

·     1.5 We may, from time to time, decide to change, update, or discontinue certain features of the Website. You agree and understand that we have no obligation to store or maintain your Content or other information you provide, except to the extent required by the Applicable Law(s).

·     1.6 The Website may include external links to third-party websites such as but not limited to Google location, Twitter, Pinterest and YouTube (“External Sites”). We do not investigate, review, endorse, represent, or control the content of any External Sites, unless otherwise expressly stated in these Terms. We shall not be held responsible or assume any liability towards the content displayed on External Sites. External Sites may collect your data, send cookies, solicit personal information or otherwise, and you are responsible for reviewing the External Site’s terms and conditions and privacy policy and you hereby acknowledge that you access, browse, link, and/or bookmark the External Sites at your own risk.

·     1.7 The Website may contain links to YouTube videos that have been produced for educational purposes, marketing purposes, and/or in order to depict the before and after stages of certain procedures and/or treatments of the animal(s). Prior to uploading any Content onto YouTube, The Wonder Vet shall attain consent from the Owner of the animal(s). Furthermore, any consent attained either verbally and/or in writing for the Content, prior to any third party owning the animal(s), shall be understood to be valid and legal consent, and the Content may be uploaded onto You Tube at the sole discretion of The Wonder Vet. In such cases, the third party shall hold no legal rights over the Content produced and distributed on You Tube.

·     1.8 We may also select certain websites as priority responses to search terms that you enter, and we agree to allow advertisers to respond to certain search terms with advertisements or sponsored content. We do not recommend, nor do we endorse, the content of any third-party websites. We are not responsible for the content of linked third-party websites, websites framed within our website, third-party websites provided as search results, or third-party advertisements, and do not make any representations regarding their content or accuracy. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites. We do not endorse any Service(s) advertised on the Website.

·     1.9 Some Content you see or otherwise access on, or through the Website, is used for commercial purposes. You agree that we may place advertising and promotions on the Website for commercial purposes.

·     1.10 In the event of any breach or violation of any Terms hereunder The Wonder Vet reserves the right to pursue legal remedies available under the Applicable Law(s).

 

 

Booking Process

 

·     1.11 Should the User wish to book an appointment for the Service(s) provided by The Wonder Vet, they may attempt to do so by requesting for an appointment on the Website. Whilst requesting for an appointment, the User shall be required to provide information including, but not limited to, their name, animal’s name, e-mail address, contact number, and a message detailing the Service(s) they wish to avail from The Wonder Vet. Additionally, the User may request a preferred date and time for the appointment, which The Wonder Vet may consider at their sole discretion.

·     1.12 It shall be in The Wonder Vet’s sole discretion to decide whether or not to confirm the appointment with the User. A member from the The Wonder Vet team may confirm or reject the appointment, either through the phone, email, or any other means of communication, based on the availability and type of Service(s) requested by the User.

·     1.13 It shall be at The Wonder Vet’s sole discretion to refuse any User that violates the Terms stated herein.

 

 

Referral Process

 

• 1.14 Should a User and/or Owner be interested in availing imaging Service(s) such as an MRI or CT scan, they may do so only if they have been referred to The Wonder Vet by a veterinarian (“Referral”). For the purposes of this process, the referring veterinarian shall be required to provide the following information on the Website referral form, including, but not limited to, the date of referral, name of the referring hospital, name of the referring veterinarian, e-mail address of the referring veterinarian, and contact number.
• 1.15 Additionally, the referring veterinarian shall be required to provide client and patient information, including, but not limited to, the client’s name, contact number, e-mail address, patient name, species, breed, date of birth or estimated age of the patient, body weight, microchip details, patient’s gender, and the date of the last vaccination for rabies and polyvalent.
• 1.16 The referring veterinarian shall be required to provide a detailed account of the patient’s medical history, diagnosis, chronic disease, anaesthesia reaction, known allergies, sensitivities, medications, dosages, special dietary requirements, a recent complete blood count and biochemistry results, previous MRI and CT history, the anatomical region to be scanned, reason for the MRI/CT scan, and the required timeframe as the MRI and CT scans may be sent to radiologists and veterinary specialists located globally for an interpretation. In such a case, it may take an extended period of time before a response is provided. Thus, The Wonder Vet would need to be notified if the case is urgent. Through this process, the referring veterinarian may also create an account on the Website.
• 1.17 It shall be at The Wonder Vet’s sole discretion to refuse any User and/or Owner that violates the Terms stated herein.

 

 

2. PROHIBITED ACTIVITIES

 

• 2.1 The Content and information available on the Website are proprietary to The Wonder Vet or licensed to The Wonder Vet by third parties. Users agree that they shall not engage in any of the following activities in connection with their use of the Website:

·     i. post information on the Website that is obscene, defamatory, threatening, or malicious in nature, or any other material that is prohibited by the Applicable Law(s);

·     ii. publish any copyright material, or material protected by any other Intellectual Property rights, unless a legal right to use and post such material has been obtained and is valid at the time of posting;

·     iii. infringe or use The Wonder Vet’s brand, logo(s), and/or trademark(s) in any business name, e-mail, URL, or other context unless expressly approved in writing by the owner of the Intellectual Property as applicable;

·     iv. attempt to circumvent any protective technological measure associated with the Website;

·     v. violate the restrictions of any robot exclusion headers on the Website, bypass, or circumvent their measures employed to prevent or limit access to the Website;

·     vi. access, monitor, reproduce, distribute, transmit, broadcast, display, sell, license, copy, or otherwise exploit any Content of the Website, including, but not limited to, User profiles and photos, using any robot, spider, scraper, or other automated means, or any manual process for any purpose not in accordance with these Terms, or without the express written authorisation from The Wonder Vet;

·     vii. attempt to access or search the Website or any Content contained therein through the use of any engine, software, tool, agent, device, or mechanism (including scripts, bots, spiders, scraper, crawlers, data mining tools or the like) other than through software generally available through web browsers (such as search engines like Google and Yahoo);

·     viii. download any Content unless it is expressly made available for download by The Wonder Vet from the Website;

·     ix. post, upload, transmit, or otherwise distribute chain letters, pyramid schemes, advertising, or spam;

·     x. impersonate or misrepresent your affiliation with another person or entity;

·     xi. harvest or otherwise collect information about others, including telephone numbers for unlawful purposes;

·     xii. interfere with, or disrupt any of the associated computer or technical delivery systems;

·     xiii. interfere with, or attempt to interfere with, the access of any User, host, or network, including, but not limited to, sending a virus, overloading, flooding, spamming, or mail-bombing the Website;

·     xiv. modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through the Website; and

·     xv. use the Website, or any Content on the Website, in any manner not permitted by these Terms.

 

• 2.2 Users agree not to use the Website in any way or action that may:

·     i. cause damage to, or impair the performance of the Website, inclusive of its availability and accessibility to Users and The Wonder Vet;

·     ii. be illegal, fraudulent, or harmful to any person or company in any direct or indirect manner; and

·     iii. use the Website to copy, store, host, transmit, send, use, publish, or distribute any material which consists of (or is linked to) any spyware, computer virus, trojan horse, worm, keystroke logger, rootkit, or other malicious computer software.

 

3. CONTENT

• 3.1 Ownership of The Wonder Vet’s Content and Intellectual Property Rights

·     i. Subject to the express provisions of these Terms, we own, control, license, or reserve all Intellectual Property rights and Content used on the Website. You agree not to use, remove, alter, modify, create derivative works of, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Website or Content. You must not use any part of the Content on our Website for commercial purposes without first obtaining a license to do so from us or our licensors;

·     ii. Any/all Content posted on the Website and/or submitted by the Users to The Wonder Vet has been licensed to The Wonder Vet for any/all purposes The Wonder Vet may deem necessary in order to run the Website. We authorise you to view or download a single copy of the material on the Website solely for your personal, non-commercial use, if you include the copyright notice located at the end of the material, for example: and other copyright and proprietary rights notices that are contained in the Content;

·     iii. Any use of the Content not expressly permitted by these Terms is a breach of these Terms and may violate Intellectual Property, and other Applicable Law(s). Content and features are subject to change or termination without notice in the editorial discretion of The Wonder Vet. All rights not expressly granted herein are reserved to The Wonder Vet.

 

• 3.2 Your License to The Wonder Vet’s Content

 

·     i. We grant you a personal, limited, non-exclusive, and non-transferable license to access and use the Website only as expressly permitted in these Terms. You shall not use the Website for any illegal purpose or in any matter inconsistent with these Terms. You may use information made available through the Website solely for your non-commercial use and in order to avail of the services displayed on the Website. You agree not to use, copy, display, distribute, modify, broadcast, translate, reproduce, reformat, incorporate into advertisements and other works, sell, promote, create derivative works, or in any way exploit or allow others to exploit any of our Content in whole or in part, except as expressly authorized by us. Except as otherwise expressly granted to you in writing, we do not grant you any other express or implied right or license to our Content or Intellectual Property rights;

·     ii. If you violate any of these Terms, your permission to use the materials automatically terminates and you must immediately destroy any copies you have made of any part of the materials. You may also be potentially liable for Intellectual Property rights infringement based on the circumstances.

 

• 3.3 The Wonder Vet’s License to User Content

 

·     i. Upon submission of Your Content, you hereby grant The Wonder Vet a perpetual, non-exclusive, irrevocable, fully paid, royalty-free, assignable, sub-licensable, and transferable right to use Your Content and all Intellectual Property rights therein for any purpose or use that we deem necessary;

·     ii. For the avoidance of doubt, “Use” means, but is not limited to, use, copy, display, distribute, modify, translate, reformat, incorporate into advertisements and other works, analyse, promote, commercialise, and create derivative works of;

·     iii. You grant us the right to use the name or username that you submit in connection with Your Content. You irrevocably waive any claims and assertions of moral rights or attribution with respect to Your Content brought against us or our Users;

·     iv. You represent and warrant that Your Content is accurate, that the use of Your Content does not violate these Terms and will not cause injury to any person or entity, and that you will indemnify The Wonder Vet from any/all claims resulting from Your Content;

·     v. We reserve the right, at any time and without prior notice, to remove, block, or disable access to whole or any part of Your Content that we, for any reason consider to be objectionable, in violation of the Terms or otherwise harmful to the Website or our Users at our sole discretion. Subject to the requirements of the Applicable Law(s), we are not obligated to return any of Your Content to you under any circumstances and assume no liability for any Content posted by You.

 

4. USER RATING, REVIEWS, AND FEEDBACK

 

• 4.1 Users are able to rate, review, and provide feedback on the Website on platforms, including, but not limited to, Google Reviews.
• 4.2 User reviews, ratings, and/or feedback posted on any platform do not reflect the opinion of The Wonder Vet. The Wonder Vet receives multiple reviews by Users, which reflect the opinions of each individual User. It is pertinent to state that each and every review posted on Google Reviews is the personal opinion of that User alone.
• 4.3 Users agree that they shall use reasonable and good faith efforts to ensure that neither engages in any harassment and/or vilification of each other and the Website, to third parties, and shall refrain from making any false, negative, critical, or disparaging statements, implied or expressed, concerning The Wonder Vet, including, but not limited to, its associates, employees, consultants, veterinarians, and nurses, and its Website. This, however, shall not apply towards any truthful statement made as required by any Applicable Law(s) or by a court or authority of competent jurisdiction.
• 4.4 Furthermore, The Wonder Vet shall have at its sole discretion the right to edit, delete, and/or amend any ratings, reviews and/or feedback provided by the User. Additionally, The Wonder Vet shall have at its sole discretion the right to reproduce any ratings, reviews and feedback provided online on the Website.
• 4.5 Moreover, The Wonder Vet shall be conducting surveys through Survey Monkey and/or other platforms to assess factors including, but not limited to, to the use of the Website.
• 4.6 Users agree and accept that by providing your Content to or through the Website, you grant us a non-exclusive, royalty-free, perpetual, transferable, irrevocable, and fully sub-licensable right to:

·     i. host, use, reproduce, modify, run, adapt, translate, distribute, publish, create derivative works from, and publicly display and perform such Content of yours throughout the world in any media, now known or hereafter devised;

·     ii. make your Content available to the rest of the world and to let others do the same;

·     iii. to provide, promote, and improve the Website and to make your Content shared on the Website available to other companies, organisations, or individuals for the syndication, broadcast, distribution, promotion, or publication of such Content of yours on other media and services, subject to our Privacy Policy and these Terms; and

·     iv. use the name and/or trademark that you submit in connection with such Content of yours. You acknowledge that we may choose to provide attribution of Your Content at our discretion. You acknowledge and agree that Your Content is non-confidential and non-proprietary. You affirm, represent, and warrant that you own or have the necessary licenses, rights (including copyright and other proprietary rights), consents, and permissions to publish and otherwise use Your Content as authorized in these Terms.

• 4.7 The Terms of this Clause 4 do not grant other Users a license to host, use, reproduce, modify, run, adapt, translate, distribute, publish, create derivative works from, and publicly display and perform such Content of yours throughout the world in any media, now known or hereafter devised.

 

5. ONLINE COMMUNICATION GUIDELINES

• 5.1 Pursuant to Clause 4 above, our Website enables Users to rate, review, and provide feedback regarding our Website via online platforms including, but not limited to, Google Reviews. This information will then be reviewed by The Wonder Vet and posted on the Website at their sole discretion. Users should ensure appropriate online conduct and behaviour in which The Wonder Vet reserves the right to review all posts, prior to the feedback posts being visible to other Users on the Website.
• 5.2 The Website is only to be used for its intended purpose. You may not use the Content provided through the Website in any manner or for any purpose other than that which is expected.
• 5.3 Any/all ratings, reviews, and feedback should be conducted in a professional and respectful manner. Abusive or offensive language, which may be deemed as political, discriminative, threatening, sexual, or of religious nature, as well as any other inappropriate behaviour which violates our Terms, will not be tolerated on our Website and may result in review and action, including temporary or indefinite suspension and/or termination from the use of our Website
• 5.4 You may not post or submit Content that includes inflammatory speech, endorses, or promotes illegal, immoral, or harmful activities, including obscene content, incitement of lawless action, or activities that may lead to other Users’ harm in any manner.
• 5.5 You may not post or submit information or comments on the Website and on third-party social media platforms that are obscene, defamatory, threatening, malicious, slanderous, or disparaging in nature, or any other material that is prohibited by law, about The Wonder Vet and its Website.
• 5.6 Any dispute, complaint, disagreement, or conflict with any User, should be brought to the attention of The Wonder Vet The Wonder Vet shall not bear any liability for mitigating such disputes between the parties as this will be the sole responsibility of the parties involved.
• 5.7 Users acknowledge and accept that an actual or threatened breach of any Term(s) of this Clause 5 may be penalized by implementing the following:

·     i. Disqualifying their use of our Website indefinitely unless a written approval has been obtained by us allowing them to use the Website.

• 5.8 The Wonder Vet shall not be held liable for any loss or damage experienced by any person as a result of implementing the penalties above.
• 5.9 The Wonder Vet shall not be liable for any direct, indirect, or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), claims of death or personal injury, costs, expenses, or other claims for consequential compensation whatsoever (and howsoever) caused, including slander or personal offence which arise out of use or in connection with the Website’s communication and/or communications taking place between the User and The Wonder Vet.

 

6. WARRANTIES FOR USE OF THE WEBSITE

• 6.1 You agree and acknowledge that the Website is provided on an “as is” basis. Except as otherwise specifically set forth herein, The Wonder Vet does not make, and hereby disclaims any and all warranties, express or implied, including, but not limited to, implied warranties of availability, merchantability, quality, fitness for a particular use or purpose, technical performance, quiet enjoyment or non-infringement, and any warranties arising out of course of dealing or usage of the Website.
• 6.2 We make no warranty that the Website, or Content provided therein will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We make no warranty as to the accuracy, timeliness, completeness, or reliability of any Content obtained through the Website. No information provided through the Website or by us, whether in oral or written form, will create any warranty not expressly made herein. Your reliance upon the Content obtained or used by you through the Website is solely at your own risk.
• 6.3 The Wonder Vet does not endorse any Content posted, submitted, or otherwise provided by any User, or any opinion, recommendation, or advice expressed therein. We expressly disclaim any and all liability in connection to such Content. You agree that we are not responsible for the accuracy, consistency, or completeness of information uploaded and displayed on our Website.
• 6.4 The Wonder Vet takes no responsibility and assumes no liability for any Content posted, stored, transmitted, or uploaded to the Website by you (in the case of Your Content), or any third party (in the case of any and all Content more generally), or for any loss or damage thereto, nor are we liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography, or profanity you may encounter.
• 6.5 Users agree that The Wonder Vet may upload photos and/or videos taken of their animal(s) onto social media platforms including, but not limited to, Facebook, Instagram, and YouTube for marketing and educational purposes. This shall be done once The Wonder Vet obtains the User’s consent for the same.
• 6.6 Users must ensure the accuracy and authenticity of any and all information they supply to us through the Website including, but not limited to, personal data, as well as information supplied by the User on behalf of any third-party the User wishes to refer to The Wonder Vet.
• 6.7 Users acknowledge that The Wonder Vet will process personal data including, but not limited to, names and e-mail addresses in order to provide continued access to the Website, make improvements to the Website, and prevent unauthorised use of the Website.
• 6.8 Users agree that The Wonder Vet is not responsible now or at any time in the future for any unauthorised access including, but not limited to, any virus or other harmful code that may infect the User’s computer, tablet, smartphone, or any other such device as a result of using the Website.
• 6.9 Users accept that The Wonder Vet shall not be held responsible and/or liable for any misrepresentations made by the User.
• 6.10 Users shall be responsible for obtaining, maintaining, and setting up any equipment and/or hardware required to access and use the Website and the User shall take responsibility for the protection of this equipment and/or hardware by using up-to-date virus protection, personal firewalls, and any other suitable measures the User deems necessary to ensure the security of the Website is not compromised.
• 6.11 Users accept that The Wonder Vet shall not be held liable in the event the Website transmits information that has been accessed, altered, and/or corrupted.
• 6.12 Users accept that The Wonder Vet may be required to suspend access to the Website for periodic maintenance and/or unforeseen downtime and may do so at its own sole discretion without serving any prior notice.
• 6.13 All interactions between Users and The Wonder Vet must be carried out in a responsible, ethical, professional, and legal manner.
• 6.14 We may do any or all of the following without notice:

·     i. investigate your use of the Website as we deem appropriate to comply with any Applicable Law(s), regulation(s), government request(s), or legal process(es);

·     ii. terminate your access to the Website, upon our determining on whether you have violated these Terms; and

·     iii. edit the Website and any Content without giving you prior notice.

• 6.15 While using the Website, you make the following representations and warranties to The Wonder Vet:

·          

·     i. you are eighteen (18) years of age or older and are legally allowed to use the Website; and

• ii. you acknowledge and understand that you are solely responsible for any information you may choose to disclose to The Wonder Vet.
• 6.16 The Materials advertised on the Website shall be made available to Users of the minimum age of eighteen (18). We are committed to protecting the privacy of children. Hence, we do not encourage persons under the age of 18 (“Minor”) to use the Website. If a Minor would like to access the Website, they should take the assistance of a parent/guardian/adult authorized with that Minor’s supervision. We do not personally collect identifiable information from any person we know is a Minor.
• 6.17 In the event, a Minor has used the Website for any purposes, the User warrants and represents that such actions are performed under the guidance of an adult after obtaining the relevant consent from the parent/guardian and/or adult. The User accepts that the Minor is bound by the same Terms and agrees that The Wonder Vet is not liable or responsible for the User’s failure to act in accordance with this Clause 6.17.
• 6.18 When a User visits the Website or sends us e-mails, they are communicating with us electronically, and they hereby consent to receiving communications from us electronically. We will communicate with Users primarily by e-mail but may use other methods such as telephone or WhatsApp to communicate if we deem it necessary to do so. Users agree that all agreements, notices, disclosures, and other communications that we provide to Users electronically satisfy any legal requirement that such communications be in writing. Users agree to provide us with their current and active contact details.
• 6.19 We hereby exclude any and all other representations and warranties relating to the subject matter of these Terms, the Website, and use of the Website in any manner other than expressly stated herein.
• 6.20 Owners must ensure the accuracy and authenticity of any and all information they supply to us, including, but not limited to, personal data, as well as information supplied by the Owner on behalf of any third-party the Owner wishes to refer to The Wonder Vet.
• 6.21 Owners accept that The Wonder Vet shall not be held responsible and/or liable for any misrepresentations made by the Owner.

 

II. The Wonder Vet – SERVICES AVAILED IN PERSON

• 1. USE OF THE SERVICES

·          

·         1.1 Whilst using the Service(s) provided by The Wonder Vet, you represent and warrant that all information provided to us in such process is true, accurate, and correct, and that you will update your information as and when necessary in order to keep it recent. You may not impersonate any person or entity, provide an e-mail address other than your own, provide or use false information to obtain access to The Wonder Vet that you are not legally entitled to claim, or otherwise mislead as to the origin of a card or other content. You acknowledge that any access to The Wonder Vet using falsely claimed information may cause us, or third parties, to incur substantial economic damages and losses for which you may be held liable and accountable.

·         1.2 Whilst availing of the Service(s) provided by The Wonder Vet, the Owner may consent to the creation of Content, that may feature themselves and/or the animal(s) brought in by them. This Content may be created by The Wonder Vet for educational and/or marketing purposes and may be stored and/or uploaded onto social media platforms including, but not limited to, YouTube. For the purposes of such Content, any consent obtained prior to a third party owning the animal(s), shall be held to be valid and legal consent.

·         1.3 In the event of any breach or violation of any Terms hereunder, The Wonder Vet reserves the right to pursue legal remedies available under the Applicable Law(s).

 

Booking Process

·     1.4 Owners interested in availing of the Service(s) provided by The Wonder Vet’s may call us on our phone number to book an appointment. It shall be at The Wonder Vet’s sole discretion to decide whether or not to confirm the appointment with the User. A member of the The Wonder Vet team may confirm or reject the appointment with the Owner, based on the availability and type of Service(s) requested by the Owner.

·     1.5 In the case of an emergency and/or a life-threatening issue, the Owner may directly call the emergency number provided to them, including after hours if needed. The Owner may then be directed to The Wonder Vet, where they shall await the arrival of the doctor and make any/all payments required, which may include, but is not limited, to the emergency surcharge fee.

·     1.6 It shall be at The Wonder Vet’s sole discretion to refuse any Owner that violates the Terms stated herein.

 

2. PAYMENT TERMS

• 2.1 Owners shall pay The Wonder Vet either in-person or online, in ways including, but not limited to, cash, card, or via an online payment link, for each booking and/or Referral on the day of the appointment.
• 2.2 Payment for outpatient Service(s)

·     i. For the purposes of this outpatient Service(s) shall include Service(s) wherein the animal shall not be required to stay at The Wonder Vet in order to receive treatment. This may include, but is not limited to, consultation Service(s).

·     ii. Where an Owner avails of outpatient Service(s), the veterinarian shall check the concerned animal(s) and enter the relevant charges on the VET port software. This shall save the relevant charges on the chart and in the The Wonder Vet database.

·     iii. In such instances, the Owner shall be required to pay the total amount in full at the The Wonder Vet reception or online through a payment link , prior to the procedure and prior to the Owner leaving the hospital. The total amount to be paid is the sum of the total amount for all the outpatient Service(s) provided by The Wonder Vet, including any additional outpatient Service(s) availed by the Owner, or recommended by the veterinarian (“Total Amount for the outpatient Service(s)”).

·     iv. In the case of some Owner(s), where a memorandum of understanding or another agreement has been signed between them and The Wonder Vet, payments shall be processed at the end of the month or after the appointment or procedures have been completed. In such situations, no deposits shall be taken from the Owner(s).

·     v. Payment for outpatient Service(s) may be conducted via cash, card, or through an online payment link. Owners shall receive an email with a payment link, which they must settle prior to the requested Service(s) being conducted and prior to them leaving the hospital. You shall ensure that any/all information you provide is accurate, including your payment details. We may, at any time, add or remove third-party payment facilitators at our sole discretion, which may be subject to additional terms and conditions.

·     vi. The Wonder Vet shall not be held liable for the online payment whatsoever, including, but not limited to, the safety and security of your payment information once you have been redirected to the respective third-party payment facilitator’s webpage in order to complete your purchase. Your use of the same is subject to the compliance of their respective policies and terms and conditions.

·     vii. Kindly note that in the event payments have not been made, we reserve the right to not provide the requested Service(s) entirely.

·     viii. Once the payment has been made in full, the Owner shall not be able to cancel the payment and/or Service(s) whatsoever.

·     ix. If the Owner wants a refund for any reason whatsoever, the Owner must submit a request in writing to The Wonder Vet for the same. Refunds may be given in very exceptional circumstances, which shall be determined at the sole discretion of The Wonder Vet.

 

 

 

 

 

 

Your use of the Website and services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Website including the applicable policies which are incorporated herein by way of reference. If you transact on the website, you shall be subject to the policies that are applicable to the Website for such transaction. 1.     We reserve the right to modify the Terms of Use at any time without giving you any prior notice. Your use of our services following any such modification constitutes your agreement to follow and be bound by the Terms of Use, as modified. Any additional terms and conditions, disclaimers, privacy policies, and other policies applicable to general and specific areas of our services or to any particular services offered by us are also considered as Terms of Use. By agreeing to these terms, you also agree to the terms of use of the service, which are available at www.wondervet.in.

2.     You acknowledge that you will be bound by this agreement for availing of any of the veterinary services offered by us.

3.     Your right to use our website and our veterinary services will be solely at the discretion of wondervet.in.

o    You acknowledge that you will be bound by this agreement for availing of any of the veterinary services offered by us.

o    The services may change from time to time, at the sole discretion of wondervet.in, and the agreement will apply to our veterinary home visits and home services and your use of the website to avail the veterinary service/s, as well as to all information provided by you on wondervet.in website at any given point in time.

o    This Agreement defines the terms and conditions under which you are allowed to use the Website and describes the manner in which we shall treat your account while you and/or your Pet/s are registered as a member with us. If you have any questions about any part of the Agreement, please get in touch with us at [email protected]

o    By downloading or accessing the website to use our veterinary services and products offered by wondervet.in, you irrevocably accept all the conditions stipulated in this agreement, the Pet Parent’s Consent, and any Privacy Policy, and agree to abide by them. This agreement supersedes all previous oral and written terms and conditions (if any) communicated to you relating to your use of the website to avail of our services. By availing of any veterinary service and products, you signify your acceptance of the terms of this agreement.

o    We reserve the right to modify or terminate any portion of the agreement for any reason and at any time, and such modifications shall be informed to you in writing. You should read the agreement at regular intervals. Your use of the website following any such modification constitutes your agreement to follow and be bound by the agreement so modified.

o    You acknowledge that you will be bound by this agreement for availing of any of the services offered by us. If you do not agree with any part of the agreement, please do not use the website or avail of any of our services. The agreement is published in compliance with, and is governed by the provisions of Indian law, including but not limited to:

1.     the Indian Contract Act, 1872,

2.     the (Indian) Information Technology Act, 2000, and

3.     the rules, regulations, guidelines, and clarifications framed thereunder, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”, and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (the “IG Rules”).

o    You must be 18 years of age or older to register, use our veterinary services for your pets, or visit or use the website in any manner. By registering, visiting, and using the website or accepting this agreement, you represent and warrant to wondervet.in that you are 18 years of age or older and that you have the right, authority and capacity to use the website and our veterinary services available through the website, and agree to and abide by this agreement. Read our ‘Membership and Access Bound by Local Restrictions’ section in ‘Legal’.

 

 

Vet on Call / Home Visit / Clinical Treatments

You agree that services offered to you are advised by qualified and licensed veterinary practitioners which are customized according to your and your pet’s needs. You understand and undertake the responsibility of medical services offered and risks involved therein. Services are offered between 11AM to 9PM IST, Monday to Sunday (7 days a week). The Wonder Vet availability might be affected during some unexpected issue. Wondervet.in always ensures high quality of veterinary service is provided but will not be held responsible for any lapse in service or any medicinal error including criminal activity by any veterinarians under any circumstances. You agree that in certain cases, the pet might be sedated by our veterinary practitioners in view of the existing health condition of the pet. In such scenarios, it might have some post effects life loss of balance, confusion, etc. for the pet. You provide your consent to the team to do the needful and the whole responsibility lies with you. You also agree and understand that the services offered and provided by wondervet.in or through veterinarians to you and/or your pet have a risk of failure and/or adverse effects resulting in the possible mortality of your pet. You agree and understand that Wondervet.in does not guarantee any assured recovery or assured outcome from the veterinary service offered. You agree to provide a safe environment for our service providers/veterinarians to discharge their duty and you will ensure that they are not harassed, abused, or troubled in any way physically, psychologically, or emotionally. In case any of the aforementioned circumstances arise, during or after the services are rendered/have been rendered, Wondervet.in will be authorized to take appropriate legal action. You authorize wondervet.in to collect the pet’s and your data and use/share the same with others without revealing your identity. Wondervet.in will not be responsible for misuse of your data by our veterinarians, affiliated veterinarians, employees, or other parties. You will make payments to wondervet.in as per the terms agreed and will not link it with the outcome of the service provided/to be provided. Charges will be conveyed at the time of booking and any additional charges incurred will be conveyed to you after the service. Wondervet.in work with prior appointments only. The Consultation provided by the Wondervet.in veterinary doctor partner in the Wondervet.in platform is intended for general health check-up and clinical treatment with verified veterinary doctors at nearby locations purposes only and is not meant to be used in emergencies/serious life threatening health conditions. It is the sole responsibility of the User, to book a follow up appointment for online/physical examination and in-person consultation with any Vet practitioner. Wondervet.in Vet Consultation feature is being made available to customers only to assist them to obtain Vet Practitioners and platform is not liable to any advice provided by the Vet practitioner. Wondervet.in is a platform to connect doctors and ensure high quality of Veterinary Service but will not be held liable for any Service or Medicinal error including criminal activity by any Veterinarians or any result that may have an adverse effect on you or your pet. Pet owners should be able to handle or hold their pets during treatment at home and assist the doctor during the same for home visit or treatment of animals outside in open space. If they are not able they should ask for pet handling person (separate charges for the same) or arrange by themselves in such situations. Wondervet.in cannot guarantee the availability of pet handling person at all locations. If pet/animals don’t support the treatment the consumer of the service should pay the visiting/service charges which was already done.

Grooming Services

You understand and agree that ‘Grooming’ services are available in packages and can also be tailor-made and are rendered by experienced groomers and you undertake the responsibility of any kind of mishaps and risks involved. The Grooming services are available from 10 AM to 9 PM IST, Monday to Sunday (7 days a week). wondervet.in availability might be affected during some unexpected issue. wondervet.in will ensure high-quality grooming service but will not be responsible for any disservice or grooming error including criminal activity like an injury to the pet, any harm, so on and so forth by any groomer. You understand and agree that in certain cases, the pet might be sedated on a valid vet prescription. You also understand that it might have some post effects like confusion, loss of balance, etc. You hereby provide your consent to the team to do the needful and will take full responsibility for it. You understand and agree that the services offered by wondervet.in directly or through groomers/affiliate groomers of wondervet.in have a risk of failure and/or adverse effects resulting in the possible mortality of your pet. You also understand and agree that in cases of aggressive pets, who have bitten/have a history of biting/have caused physical harm, will be muzzled to protect the pet as well as the grooming team. You understand and agree that wondervet.in does not guarantee any assured recovery or assured outcome from the grooming service offered. You agree to provide a safe environment for our service providers/groomers to discharge their duty and you will ensure that they are not harassed, abused, or troubled in any way physically, psychologically, or emotionally. In case, any of the aforementioned circumstances arise, during or after the services are rendered/has been rendered, wondervet.in will be authorized to take appropriate legal action. You authorize wondervet.in to collect the pets and their owners’ data and use/share the same with others (without revealing your identity). wondervet.in will not be responsible for the misuse of your data by our groomers, affiliates, groomers, employees, or other parties. You will make payments to wondervet.in or concerned person as per the terms agreed and will not link it with the outcome of the service provided/to be provided. Charges will be conveyed at the time of booking and any additional charges incurred will be conveyed to you after the service.

Products

You understand and agree that our products are made exclusively for pets such as Cats, Dogs, Puppies, Kittens etc. and are approved by veterinarians and that you understand and undertake the responsibility of the risks involved. Our products can be purchased from our official website (www.wondervet.in) or from other e-commerce portal/application. wondervet.in will ensure high quality of pet products but will not take any responsibility for any harm, side-effects, or failure of a product’s efficacy. You also understand that we will not be responsible for the delivery service of our products like any destruction, failure to deliver, etc. and you will be redirected to communicate your grievances with the 3rd party vendor responsible for delivery. You understand and agree that wondervet.in does not guarantee any assured recovery or assured outcome from the use of our products as each pet is different and might need special assistance. By purchasing our products, you also agree to the terms and conditions laid down by us for the return/cancellation of the same. You authorize wondervet.in to collect the pets and your data and use/share the same with others (without revealing your identity). wondervet.in will not be responsible for the misuse of your data by our behaviourists, affiliates, employees, or other parties. You will make payments to wondervet.in as per the terms agreed and will not link it with the outcome of the service provided/to be provided. Charges will be conveyed at the time of booking and any additional charges incurred will be conveyed to you after the service.

Legal

This Agreement and the Privacy Policy shall at all times govern the use of the portal/application and its services, located at (https://www.wondervet.in) along with the policies which specifically apply to you the user and Wondervet.in. This agreement has been executed and becomes applicable to you from the date on which you accepted it via the portal/application.

Alteration to Policies

Wondervet.in retains the right to alter the Terms of Operation at any time by posting the revised terms on the portal’s/application’s home page. wondervet.in at all times reserve the right to do so without giving you any prior intimation. You hereby forgo all your rights to be intimated in case of any change/alteration in the terms and conditions policy and if you continue to use the portal/application it is indicative of your acceptance of the revised terms of use. You must therefore verify the portal/application regularly for revisions and modifications that come posted online by clicking on the appropriate link. You will find a listing of all changes and their corresponding ‘Effective Dates’ as well.

Intellectual Property Rights

Thus such property on the portal/application should not form part of the trademark or as part of domain names or email addresses unless and otherwise expressly and explicitly stated and authorized by wondervet.in Further, they cannot be linked to any merchandise, item, or service which is likely to lead to ambiguity in the customer’s mind. Above all, wondervet.in does not consent to or bestow any rights or license of any kind to you under any copyrights, patents, trademarks, trade secrets, or any other intellectual property rights unless unequivocally and explicitly stated by wondervet.in in writing.

Notifications

A general notification in your account record. By an email sent to your email address which you have registered with us at the time of signing on our portal/application or by the email id that has been updated by you on our records in your registration details. This notification will be deemed to have been sent to you upon the expiry of forty-eight hours after sending the electronic mail.

Management of Reputation and Appraisal Functions

The portal/application provides services to its subscribers and users, functions of the likes of management of reputation and appraisals, surveys, blogs, a glossary of terms, and a presence on social media sites – all of which could be collectively called the ‘Boards’. wondervet.in is not in any manner responsible for the material put upon such ‘Boards’.

If any such committees, boards, panels, groups are established, Wondervet.in would merely be administering the matter on the boards and support access to such boards to be of assistance to you. It does not take responsibility for any matter posted on any of the boards. Besides, these boards can be used only in a non-commercial manner. In the event of any dispute arising between you and one or more users, or an external party for that matter, it is deemed that you release Wondervet.in from all claims, demands, and damages of all kinds – occurring both actually and consequentially. The damages could be admitted, avowed, acknowledged or unknown, suspected or unsuspected, revealed or not revealed, which may be the outcome of such disputes.

Wondervet.in advices to report all disputes occurring to any certified mediator or arbitration entity as the case may be.

Limitation of Liability

To the maximum extent as permitted by law, under no circumstances will either Wondervet.in or any of its directors, employees, agents, suppliers, or associates in collaboration with it take responsibility or bear any liability whatsoever to any person for any direct or indirect loss, liability, cost or damages of any kind. Be it under contract or TORT including carelessness or otherwise that may be resultant of using all or parts of the portal/application. Regardless of this, just in case wondervet.in is found to be liable, then the responsibility of wondervet.in and as the case may be that of Wondervet.in’s subsidiaries, directors, officers, employees, suppliers, consultants, and other associates towards you is limited to the greater of: The prices/fees that you had paid to wondervet.in the twelve months preceding the action giving rise to the liability.

Indemnity

It will be deemed that you agree to indemnify and maintain – as applicable – Wondervet.in’s parent, subsidiaries, directors, affiliates, officers, consultants, suppliers, agents, and employees as harmless from any claim, demand, or pressure, including a satisfactory amount of attorney fees, made by any third party caused by your breach of the terms of the constitution, or your violation of any law or the rights of any third party.

Conflict with Additional Terms

When we say ‘Additional Terms’ we are referring to terms, conditions, disclosures, and disclaimers, which may pertain to certain web pages or sections of the portal/application/services/products. Besides, you may enter into one or more contracts with Wondervet.in, which refer to the ‘Other Agreements’. In case of a conflict, the terms of the ‘Other Agreement’ will take priority, following which will be the ‘Additional Terms’, which will be followed by these Terms of Use/Legal.

Termination

All rights awarded to you by Wondervet.in will be brought to an end in case of any violation of these Terms of the Constitution. wondervet.in has the sole discretion to exercise the right to temporarily or permanently terminate your access to and use the portal/application at any time for whatever reason it deems fit. This will be done at any time without giving you any notice or any liability accruing on Wondervet.in’s part. Further, wondervet.in will not be liable to you or any third person in case your access to the site or its use is suspended for any reason by wondervet.in.

Choice of Law and Venue

This memorandum shall be expounded and construed with and by the laws of the Republic of India, regardless of its conflict with laws and rules in India.

Disputes of any sort will be subject to the exclusive jurisdiction of the courts situated within Pune and the consumer hereby will have to comply with the personal jurisdiction of the courts here.

Severability Clause

In case any part of the Terms of this Constitution is held to be not enforceable, such a holding will not affect the validity of the other provisions of the Terms of the Constitution, which will continue to remain wholly enforceable and effective.

General

The agreement charted out sets forth the entire understanding and agreement between the parties concerning the subject matter hereof. In the event any of the provisions of this memorandum is held to be unenforceable, such a clause shall be struck and the remaining provisions continue to be enforceable.

Wondervet.in and you are independent entities and it is deemed that no sort of partnership, agency, joint venture, employer-employee, the franchisor-franchisee relationship is in any way created or mediated through this agreement.

Wondervet.in may assign this agreement by giving you prior notification. No waiver on Wondervet.in’s part shall be deemed to be a waiver of any earlier or subsequent default hereunder. It is deemed that the following sections go beyond any termination or expiration of this agreement. License to wondervet.in No Warranty, Limitation of Liability, Release, Indemnity, Applicable Law and Dispute Resolution, and all General clauses.

Promotional Codes Terms

These are terms and conditions that commonly apply to promotions on Wondervet.in including ones where you must redeem a promotional code as part of the offer and where no alternative terms and conditions apply.

1.     Promotional codes are a limited time offer.

4.     Offer is also subject to the supplies and stock.

10.If the offer is for physical goods, the promotional code applies only to items purchased in a single order and shipped at the same speed to a single address.

Services Refund and Cancellation Policy

Vet on Call / Home visit / Clinical Appointments

Refund is not a concern as charges will be applicable on headers services since we request payment after check-up/treatment of the pet. We can book an appointment in advance but do not charge our clients until our Vet visits for consultation/service. The services can be cancelled if –

1.     Pet parent did not respond or is not available at the location

2.     Unavoidable circumstances where the vet is unable to reach the location

3.     Or if the pet needs immediate hospitalization (needs to be consulted before hand)

Package service refund will be provided on Pro rata basis in case the service is cancelled by the consumer.

Grooming

Refund not a concern on grooming services since we request payment only after the grooming of the pet is complete. We can book an appointment in advance but do not charge our customers until our groomer visits your home or you visit our store for the service.
